Terms of Service
The agreement between you and Not Quite My Tempo for using Fletcher.
1. The agreement
These terms are between you and Parshva Shah, an individual in India who operates Not Quite My Tempo at notmytempo.dev ("we"). By signing in or installing the Fletcher GitHub App, you agree to these terms and to our Privacy Policy. If you use Fletcher for an organization, you confirm you're allowed to accept these terms for it. You must be at least 16.
2. The service
Fletcher is a GitHub App that reviews pull requests in the repositories you choose, using Google's Gemini AI models, and posts the review as comments on the pull request. Workspaces, roles, and access follow your GitHub accounts and organizations.
3. Your code
Your code stays yours. You give us permission to fetch and process it, and to send it to our service providers, only as needed to provide Fletcher. You confirm you have the right to install Fletcher on those repositories. Reviews Fletcher produces for you are yours to use.
4. AI reviews
Reviews are generated by AI and can be wrong, incomplete, or miss security problems. They don't replace human review or testing, and you're responsible for what you merge. Fletcher's blunt tone is a persona, not a judgment of you.
5. Your own API key
If your workspace uses its own Gemini or Vertex AI key, Google bills you for that usage and its terms apply to it. You're responsible for keeping the key valid and within its limits. Reviews on your own key never use the paid plan's credits.
6. Trial, paid plan, and refunds
- Each workspace gets 5 free reviews on our key. The trial is per workspace and can't be reset or moved.
- Polar sells the paid plan as merchant of record, and Polar's terms also apply to your purchase. The plan renews automatically each period at the price shown at checkout until you cancel.
- You can cancel any time from the billing portal in workspace settings. You keep the plan until the end of the period you've paid for.
- The paid plan includes a number of review credits each billing period, shown on the pricing page. Each review uses credits according to its model and size. Unused credits don't carry over, and credits have no cash value. A review that fails doesn't use credits. When credits run low, reviews may switch to a smaller model from the same provider, and once none fits, they stop until the plan renews unless your workspace has its own key.
- Payments are non-refundable, except where the law requires a refund or we choose to give one.
- We'll give at least 30 days' notice before changing the price of an existing subscription.
- Fair use applies. To prevent abuse we limit how many reviews run each day, and we may limit usage that's far outside normal use.
7. Acceptable use
Don't use Fletcher to:
- break the law or infringe anyone's rights;
- attack, overload, reverse engineer, or get around the limits of the service;
- resell or share access to our platform key;
- process code you have no right to share with us and our service providers.
You must also follow the terms of GitHub and of Google's Gemini API when using Fletcher.
8. Suspension and ending
You can stop using Fletcher at any time by uninstalling the GitHub App, and delete your account or, as an owner, a workspace's data in Fletcher (see the Privacy Policy for what that removes). We may suspend or end access if you break these terms, or if we need to in order to protect the service or other users. If we shut down Fletcher, we'll give reasonable notice where we can.
9. Disclaimers
Fletcher is provided "as is" and "as available". To the extent the law allows, we make no warranties, including that it will be uninterrupted, error-free, or fit for a particular purpose. We depend on GitHub, Google, Cloudflare, and Polar, and we're not responsible for their outages.
10. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, or consequential losses, or for lost profits, data, or goodwill. Our total liability for any claim about Fletcher is limited to the amount you paid us in the 12 months before the claim, or USD 50 if that's more. Nothing in these terms limits liability that can't be limited by law, or takes away your rights as a consumer.
11. Indemnity
You'll cover our reasonable losses from claims that arise because you broke these terms or processed code you had no right to share.
12. Governing law
These terms are governed by the laws of India, and the courts of India have jurisdiction, unless consumer law in your country gives you the right to bring a claim where you live.
13. Changes
We may update these terms. We'll post the new version here and update the effective date. For material changes, we'll give notice in the app at least 14 days before they take effect. If you keep using Fletcher after that, you accept the new terms.
14. Contact
